Terms of Service
The agreement between you and LeagueBucket for using the service -- including what we commit to about advertising, Member data, and access to stats.
{{PLACEHOLDER}} marks a fact that has not been decided or does not exist yet. Do not treat this page as legally binding until it has been reviewed by an attorney and republished with a real effective date.1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and LEAGUEBUCKET LLC ("LeagueBucket," "we," "us," or "our"), a company based in 212 N 2nd St Ste 100, Richmond, KY 40475, governing your access to and use of the LeagueBucket website, applications, and related services (together, the "Service").
By creating an account, accepting an invitation to join a league on LeagueBucket, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of a league, club, or organization, you are agreeing on that organization's behalf as well as your own, and you represent that you have the authority to do so.
These Terms take effect on {{EFFECTIVE_DATE}}. If you do not agree to them, do not use the Service.
2. Who can use LeagueBucket -- adults only, for now
LeagueBucket is an adult-only service at this time. You must be at least 18 years old -- or the age of majority where you live, if that is older -- to create an account, be added as a league member with an account of your own, or otherwise have any personal information about you stored in the Service.
We know youth leagues want this product too, and we intend to build a version of LeagueBucket that supports them properly -- with the additional consent, safety, and data-handling protections that involving minors requires. Until that exists, commissioners and members must not enter any information about a person under 18 into the Service: no name, birthdate, contact information, or player record for a minor. If you run a youth league and want to be notified when we support it, you can join the waitlist without giving us anything about the children involved -- see the "youth leagues coming soon" waitlist, which collects only the requesting adult's own contact details.
If we learn that we have collected information about someone under 18 in violation of this section, we will delete it. See the Privacy Policy's "Children's Privacy" section.
3. The Service
LeagueBucket provides schedules, standings, rosters, member communication, and (on paid tiers) payment collection for local leagues -- trivia, board game, bar, kickball, and other adult recreational leagues. The features available depend on the plan a league's commissioner has chosen; the current plans and what each includes are described on our pricing page.
We may add, change, or remove features over time. We will not remove a feature a league is actively relying on without reasonable notice, and we will never retroactively take away something a Free-tier league already had when we change what Free includes going forward (see the pricing page's grandfathering commitment).
Some things we describe elsewhere as "coming soon" -- for example, live mobile scorekeeping -- are not yet available. We label those clearly as not-yet-shipped wherever we mention them; if a claim on our site is not clearly labeled that way, it should be available today, and you should tell us at support@leaguebucket.com if it isn't.
4. Accounts
You are responsible for the accuracy of the information you provide when creating an account, and for keeping your login credentials secure. Tell us immediately at support@leaguebucket.com if you believe your account has been accessed without your permission.
A league's commissioner (or another admin they've added) is responsible for the accuracy of the league, season, team, roster, and game information they enter, and for having the right to enter it -- including having whatever consent is appropriate from the people they add as members, coaches, officials, or players.
5. No advertising, no sale of Member data, no paywalled stats
This section is the contractual version of what we say everywhere else on our site: LeagueBucket does not run ads, does not sell Member data, and does not paywall stats. It applies to every plan -- Free, Commissioner, and League Pro -- with no exceptions and no fine print elsewhere in these Terms that takes it back.
For purposes of this section: "Member" means anyone who is part of a league on LeagueBucket other than as a paying commissioner -- players, parents, spectators, officials, and followers. "Stats" means standings, schedules, rosters, scores, results, and player statistics for a league a Member is part of, or that is public. "Sell" has the broad meaning some privacy laws give it, including exchanging personal information for money or other valuable consideration -- not just a literal sale.
While these Terms are in effect:
- No third-party advertising, on any plan. We do not sell ad space on LeagueBucket, insert ads we control into any page or message, or let a third party place advertising in front of a league's Members without that league's own choice to display it (see "Sponsor content is not third-party advertising" below for the one deliberate exception).
- No sale of Member data. We do not sell, rent, or trade a Member's personal information to advertisers, data brokers, or any other third party. Information about Members is used to run the Service for their league and for nothing else -- see the Privacy Policy for the full detail.
- No paywalling of Stats to Members. If you are a Member of a league, every stat, standing, schedule, and result for that league is free for you to see, regardless of which plan the league's commissioner is on. Plan tiers govern what a commissioner can do -- create seasons, send messages, collect dues -- never what a Member can see.
5a. If any of that changes
We are not promising this forever, and we would rather say so than imply a permanence we cannot guarantee. What we do commit to is notice: if we change any of the three commitments in section 5, we will publish the change and email account holders at least 30 days before it takes effect.
Thirty days is enough time to read what changed, export your league's data -- which is free, on every plan, and never requires contacting us -- and leave if you want to. A commitment you can see coming and walk away from is worth more than one that could be rewritten overnight, and it is a promise we can actually keep.
6. Sponsor content is not third-party advertising
LeagueBucket's Sponsor Kit lets a league's own commissioner choose to display sponsor logos, sponsor-funded awards, and sponsor acknowledgments that the league itself has arranged -- for example, a local bar that sponsors a trivia night. This is different from the third-party advertising section 5 rules out: it is content the league's own commissioner chose to add, about a business relationship the league itself entered into, and it can be turned off by that commissioner at any time. LeagueBucket does not sell this placement to sponsors directly, does not choose which businesses appear, and does not insert sponsor content into a league that hasn't chosen to use the Sponsor Kit.
7. Payments and fees
Paid plans (Commissioner and League Pro) are billed in advance on a monthly or annual basis through our payment processor, Stripe. Prices are shown on the pricing page and in your account's billing settings before you're charged. You can cancel a paid plan at any time from your account's billing settings; cancellation takes effect at the end of the current billing period, and we do not require you to contact us to cancel.
League Pro leagues that collect registration fees or dues through LeagueBucket are charged a platform fee on amounts collected, as described on the pricing page. Card processing is handled entirely by Stripe -- LeagueBucket never receives or stores full card numbers.
If a league chooses to pass processing fees on to the person paying, that will be disclosed clearly at checkout, as a separate line item, before payment -- never as a surprise added afterward.
We do not offer a credit-card-required free trial. The Free plan is free indefinitely, with no card required, for as long as a league fits within its limits.
8. Acceptable use
Using the Service to do anything unlawful, to harass or endanger anyone, to collect information about a minor, to interfere with the Service's operation, or to access another league's private data without authorization is prohibited. The full Acceptable Use Policy is part of these Terms by reference.
9. Your content and our license to it
Leagues, commissioners, and Members retain ownership of the content they submit to LeagueBucket -- rosters, schedules, results, messages, photos, case studies, and the like ("Your Content"). By submitting Your Content, you give LeagueBucket a license to host, store, reproduce, and display it as needed to operate the Service -- for example, showing a league's public schedule page, or including a photo you uploaded in a sponsor deck the commissioner generates. That license ends when Your Content is deleted from the Service, except where we're required to keep a copy (for example, financial records) or where it's been shared onward in a way that isn't practical to unwind (for example, a sponsor deck already sent to a sponsor).
"LeagueBucket," our logo, and the software and design of the Service itself are owned by us. These Terms don't give you any rights to our trademarks or brand beyond what's needed to use the Service normally.
10. Privacy
Our Privacy Policy explains what information we collect, how we use it, and the commitments in section 5 above in full detail. For league data specifically -- rosters, member contact information, and similar -- our Data Processing Addendum describes the relationship between a league (as the party responsible for its members' data) and LeagueBucket (as the service that processes it on the league's behalf).
11. Termination
You can stop using the Service and close your account at any time. We may suspend or terminate access to the Service for an account or league that violates these Terms, the Acceptable Use Policy, or applicable law, or that we reasonably believe is putting the Service or other users at risk -- including a league that continues to enter information about a person under 18 after being told to stop. Where practical, we'll tell you why and give you a chance to fix the problem first.
If a paid league's account is terminated for cause, no refund is owed for the remainder of the current billing period, except as required by law or as we decide to offer at our discretion.
12. Disclaimers
The Service is provided "as is" and "as available." We work to keep it reliable, but we do not guarantee it will be uninterrupted, error-free, or available at all times. To the fullest extent the law allows, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.
{{PLACEHOLDER: a lawyer should confirm this disclaimer language and its formatting -- some jurisdictions require warranty disclaimers to be conspicuous (e.g., capitalized) to be enforceable.}}
13. Limitation of liability
To the fullest extent the law allows, LeagueBucket will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) {{LIABILITY_CAP_FLOOR_AMOUNT}}.
{{PLACEHOLDER: the liability cap floor amount, and whether this cap should be structured differently, is a legal judgment call -- flagged for counsel, not decided here.}}
14. Indemnification
You agree to defend and indemnify LeagueBucket against claims arising from your violation of these Terms, your misuse of the Service, or content you submit that infringes someone else's rights or violates the law -- except to the extent the claim is caused by our own breach of these Terms.
15. Dispute resolution and governing law
{{PLACEHOLDER: dispute-resolution mechanism (arbitration clause and class-action waiver, vs. ordinary courts) is a substantive legal judgment call, not decided in this draft -- see progress/track-a3.md.}}
These Terms are governed by the laws of {{GOVERNING_LAW_JURISDICTION}}, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in the courts located in {{GOVERNING_LAW_JURISDICTION}}, and you consent to that jurisdiction and venue.
If you are located outside the United States, additional local consumer-protection rights may apply to you regardless of this section; see the Privacy Policy's "International visitors" section.
16. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will give notice -- for example, by email to league commissioners or a notice in the Service -- before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
